Terms of Service

These Terms of Service (“Terms”) govern your use of the Pinmoji mobile application (“App”) operated by Pinmoji (“we,” “our,” or “us”). By downloading, installing, or using the App, you agree to these Terms.

1. Eligibility

You must be at least 13 years old to use Pinmoji. By using the App, you represent that you are at least 13 years old. If you are between 13 and 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms.

2. Account Registration

You may use Pinmoji as a guest or create an account via Sign in with Apple or email. You are responsible for maintaining the confidentiality of your account and for all activity under your account. You agree to provide accurate information and to update it as necessary.

3. User Content

3.1 Your Content

You retain ownership of the emoji statuses, text, and profile information you post (“User Content”). By posting User Content, you grant us a non-exclusive, worldwide, royalty-free license to display, distribute, and store your User Content for the purpose of operating the App.

3.2 Content Standards

You agree not to post User Content that:

  • Is illegal, threatening, abusive, harassing, defamatory, or obscene
  • Promotes violence, discrimination, or hatred
  • Contains spam, malware, or deceptive content
  • Infringes on intellectual property rights of others
  • Impersonates another person or entity
  • Contains personal information of others without their consent

3.3 Content Moderation

We reserve the right to remove any User Content that violates these Terms, without prior notice. We provide in-app tools to report and block users. We aim to review reports within 24 hours. Repeated violations may result in temporary or permanent account suspension.

3.4 Ephemeral Content

Statuses are designed to be temporary and will be automatically removed from public view when they expire. Expired statuses may remain in your personal history based on your subscription tier’s retention period.

4. Location Data

Pinmoji requires location access to function. By using the App, you consent to the collection and use of your location data as described in our Privacy Policy. You may revoke location access at any time through your device settings, though this will limit App functionality. All stored location data is fuzed to approximately 11-meter precision.

5. Subscriptions and Purchases

5.1 Lifetime Tiers

Pinmoji offers optional lifetime (one-time purchase) premium tiers: Bronze ($0.99), Silver ($1.99), Gold ($3.99), and Diamond ($9.99). These are non-consumable in-app purchases processed through Apple’s App Store.

5.2 Payment

All purchases are processed by Apple through the App Store. You agree to Apple’s terms and conditions for in-app purchases. Prices are in USD and may vary by region based on Apple’s currency conversion.

5.3 Refunds

Refund requests must be submitted through Apple. We do not process refunds directly. Visit reportaproblem.apple.com to request a refund from Apple.

5.4 No Pay-to-Win

Premium tiers provide cosmetic enhancements and convenience features only. Core functionality including posting, liking, discovering, and leaderboard participation is available to all users for free.

6. Prohibited Conduct

You agree not to:

  • Use the App for any illegal purpose
  • Attempt to gain unauthorized access to the App or its systems
  • Interfere with or disrupt the App’s infrastructure
  • Create multiple accounts to circumvent rate limits or bans
  • Use automated means (bots, scrapers) to interact with the App
  • Manipulate leaderboards through artificial means
  • Harass, stalk, or intimidate other users

7. Rate Limits

To maintain a quality experience, posting is limited to 5 statuses per hour per user. Attempting to circumvent these limits may result in account suspension.

8. Intellectual Property

The App, including its design, code, branding, and the Pinmoji name and logo, are our property and are protected by intellectual property laws. You may not copy, modify, or distribute any part of the App without our written permission.

9. Disclaimers

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. YOU USE THE APP AT YOUR OWN RISK.

We are not responsible for User Content posted by other users. User Content does not reflect our views or opinions.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR PERSONAL INJURY.

11. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of the App, your User Content, or your violation of these Terms.

12. Account Termination

We may suspend or terminate your account at any time for violation of these Terms. You may delete your account at any time from within the App’s Settings. Upon deletion, a 30-day grace period applies before permanent data removal.

13. Changes to Terms

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the revised Terms. Material changes will be communicated through the App or via email.

14. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.
